REQUESTED MOTION:

To approve the GMP Addendum with SEMCO Construction, Inc. for the Fire Training Tower Project.

 

SUMMARY:

 The proposed GMP Addendum establishes the maximum amount payable for the construction phase of the Fire Training Tower Project in the amount of $471,558.61, inclusive of the Construction Manager's fee, bonds, insurance, and competitively procured subcontractor work.

 

The GMP incorporates Schedule 1 - Construction Manager Personnel; Schedule 2 - Contract Drawings and Specifications; Schedule 3 - GMP Bid Breakdown; and Schedule 4 - Clarifications, Assumptions, Exclusions, and Allowances.

 

BACKGROUND:

 On February 24, 2026, the Board approved an Agreement with SEMCO Construction, Inc. for Construction Management services. The agreement utilizes a competitively procured contract originally awarded by Polk County through Request for Proposals No. RFP 25-544 for Construction Management at Risk (CMAR) services. The County's use of the Polk County contract is authorized pursuant to Section 4.10.1 of the DeSoto County Purchasing Manual, which permits cooperative purchasing through competitively procured contracts of other governmental entities, thereby satisfying the County's procurement requirements while promoting efficiency and cost savings.

Under the CMAR delivery method, the Construction Manager serves as the County's representative during and construction by providing pre-construction planning, cost estimating, constructability reviews, scheduling, coordination, competitive procurement of trade contractors, construction administration, quality control, and project oversight. Unlike a traditional general contractor selected solely on the basis of price, the Construction Manager is selected based on qualifications and experience, collaborates with the owner during project development, competitively procures the trade work through sealed bids, and then manages construction pursuant to an agreed Guaranteed Maximum Price (GMP). The Construction Manager assumes responsibility for coordinating the work of the subcontractors and delivering the project within the approved GMP, subject to approved changes.

The project consists of the DeSoto County Fire Training Tower, which was acquired through a grant from the Florida Department of Financial Services, Division of State Fire Marshal. The grant provides funding for the pre-construction, purchase, and installation of the fire training tower in Arcadia, Florida, to enhance firefighter training capabilities within the County.

Consistent with its responsibilities under the CMAR agreement, SEMCO has completed the pre-construction phase and will oversee installation of the training tower. The construction work includes, among other items:

                     installation of the fire training tower;

                     foundation construction;

                     fire line and hydrant installation;

                     electrical service and associated infrastructure;

                     site coordination and construction management; and

                     overall project supervision, scheduling, inspection coordination, and closeout in accordance with the approved plans and specifications.

 

The project is to be completed in accordance with the contract drawings and specifications identified in Schedule 2 of the GMP Addendum.

As required under the CMAR agreement, SEMCO competitively solicited sealed bids from qualified subcontractors for the various trade packages comprising the project. Following receipt of the bids, SEMCO evaluated the proposals for responsiveness and responsibility, verified pricing, and assembled the lowest responsive and responsible combination of subcontractors into a proposed GMP.

This competitive bidding process satisfies the requirements of Section 255.20, Florida Statutes, governing the procurement of public construction projects. The resulting subcontractor pricing and construction costs are reflected in the GMP Bid Breakdown.

The proposed GMP Addendum establishes the maximum amount payable for the construction phase of the Fire Training Tower Project in the amount of $471,558.61, inclusive of the Construction Manager's fee, bonds, insurance, and competitively procured subcontractor work.

 

The GMP incorporates:

 

                     Schedule 1 - Construction Manager Personnel;

                     Schedule 2 - Contract Drawings and Specifications;

                     Schedule 3 - GMP Bid Breakdown; and

                     Schedule 4 - Clarifications, Assumptions, Exclusions, and Allowances.

 

Approval of the GMP Addendum will authorize SEMCO to proceed with the construction phase under the CMAR agreement at a price not to exceed the GMP, while maintaining the competitive procurement process utilized for the underlying subcontractor work and ensuring compliance with the County's procurement policies and applicable provisions of Florida law.
