REQUESTED MOTION:
To adopt an Ordinance prohibiting public camping or sleeping within county buildings or grounds, public streets, sidewalks, rights-of -way and other public ways.
SUMMARY:
Adoption of an Ordinance, on second read, to implement State HB 1365, creating F.S. 125.0231, prohibiting a County or Municipality from authorizing or allowing public sleeping or camping.
BACKGROUND:
The Legislature adopted Chapter 2024-11, Laws of Florida, making it impermissible, effective October 1, 2024, for counties and municipalities to authorize or otherwise allow public camping or sleeping at public buildings, on public grounds, property or rights-of-way, with the exception of very particular circumstances such as for recreational uses on property designated for such purpose. The new law provides for additional details, with an effective date of October 1, 2024 with civil cause of action portion of the bull taking effect January 2025. Adoption of the Ordinance will amend the DeSoto County Code of Ordinances.
