Motion to adopt the Emergency Medical Services Tax Assessment Ordinance as presented.
SUMMARY:
An Ordinance governing the Emergency Medical Services Tax Assessment and providing for collection of the EMS tax assessment in accordance with the Uniform Assessment Collection Act.
BACKGROUND:
Article VII , sections 1 and 9, Florida Construction, provide that all forms of taxation except for ad valorem taxes, are preempted to the state except as provided by general law. Section 125.271, F.S., is general law that provides for authorization of a tax available to be levied by a qualified county to fund emergency medical services. The County is authorized to levy the EMS Tax Assessment pursuant to Section 125.271, F.S., because the County is within the South Central Rural Area of Opportunity as designated by Executive Order of the Governor No. 21-149. The Ordinance provides for the governance of the imposition and collection of the EMS tax assessment in accordance with Florida Law and as more particularly set forth therein. The County Administrator authorized a special services task order in the amount of $17,000 to the County’s Legal firm to review the County’s EMS assessment program and for preparation of the EMS Tax Assessment Ordinance.
