REQUESTED MOTION:

A motion to adopt the proposed resolution approving the vacation of Right of Way and enter into the record this development review report and the findings and conclusions and all other competent substantial evidence presented at the hearing.

 

SUMMARY:

The Willie K. Campbell Trust (property owner) has submitted an application requesting the vacation (closure and abandonment) of a public right-of-way and a portion of a platted alleyway. The Board of County Commissioners held a public hearing on November 19, 2024 to establish this hearing date of December 17, 2024, per Section 20-1772.

The requested vacation of public right-of-way relates to a 60-foot wide and 450-foot-long area of right-of-way known as 3rd Street. The application is also requesting the vacation of a portion of a platted alleyway measuring 15 feet wide and 315 feet long.  Both the public right-of-way and the alleyway are platted in the Town of Fort Ogden Railroad Survey (recorded in Plat Book 1, Page 15 of Desoto County official records).

The public right-of-way subject to the vacation request is generally located in between Blocks 8 and 9 of the subdivision.  The alleyway is generally located between lots 1 and 7 and lots 11 and 17 of Block 8 of the subdivision.
