REQUESTED MOTION:
A motion to enter into the record the staff memo and all competent substantial evidence introduced at the hearing and make a recommendation to adopt/deny the resolution to modify the hours of operation.
SUMMARY:
Spanish Trails Farming & Land Company, LLC has filed a request to amend the hours of operation for the Special Exception (USE 0087-2022) for a Type IV Excavation Permit, located on SE Highway 31, which special exception was originally approved by the Board of County Commissioners as Resolution No. 2022-108 on December 13, 2022, and granted to Spanish Trails Farming & land Company, LLC.
BACKGROUND:
Spanish Trails Farming & Land Company, LLC has filed a request to amend the hours of operation for the Special Exception (USE 0087-2022) for a Type IV Excavation Permit, located on SE Highway 31, which special exception was originally approved by the Board of County Commissioners as Resolution No. 2022-108 on December 13, 2022, and granted to Spanish Trails Farming & land Company, LLC. The Preliminary Excavation Plan was also approved by the Board, as a part of the Special Exception approval on December 13, 2022.
Thereafter, on January 23, 2024, pursuant to Resolution No. 2024-008, the Board approved the final excavation plans for the project, which plans included the hours of operation of 7:00 AM to 6:00 PM Monday through Friday, and 7:00 AM to Noon on Saturday.
The instant request is to amend the hours of operation to 6:00 AM to 6:00 PM Monday through Friday, and 7:00 AM to 5:00 PM on Saturday, which is consistent and compliant with LDR Section 20-1007(c).
