To approve the First Amendment to the Agreement for County Attorney Services between DeSoto County and Nabors, Giblin & Nickerson, P.A. (“NGN”).
SUMMARY:
First Amendment/Renewal for County Attorney Services
BACKGROUND:
On October 22, 2024, the Board approved an Agreement for County Attorney Services with NGN, effective November 1, 2024, for an initial one-year term, with the ability to extend the Agreement upon mutual written agreement of the parties. The Agreement provides for NGN to serve as County Attorney and provide legal services to the County, including legal counsel to the Board of County Commissioners, County Administration, County departments, and related litigation and special legal services as authorized under the Agreement.
The proposed First Amendment extends the Agreement for an additional one-year term and revises Section 4.1 to provide for automatic annual renewals thereafter under the same terms and conditions unless earlier terminated in accordance with the Agreement.
The amendment is intended to streamline future renewals and ensure continuity and stability in the County’s legal representation while preserving the County’s existing contractual right to terminate the Agreement for convenience upon written notice, as set forth in the Agreement.
