REQUESTED MOTION:
A motion to adopt/deny the proposed resolution approving the temporary use and enter into the record the development review report and all other competent substantial evidence presented at the hearing.
SUMMARY:
The property owner has applied for a Temporary Use Permit on a 23.55-acre parcel to allow for Equipment and Construction Storage as provided for in the DeSoto County Land Development Regulations (LDR), Section 20-728(b)(7). The site is located on the southeast side of SR 72 and the property owner provided a site plan showing the proposed storage area in relation to the parcel boundaries.
BACKGROUND:
The Board of County Commissioners previously approved a Temporary Use Permit for the same use on the subject site on February 27, 2024, and the permit expired on September 30, 2024. The 22.40 site acreage referenced in Resolution 2024-013 (Exhibit C) was based on the Property Appraiser’s estimated acreage. The small increase in acreage for the current application is the result of a survey that more accurately references the parcel size as 23.55 acres.
Although the original temporary use permit expired, the equipment and construction storage has continued on site for the nearby FDOT roadway improvements. The property owner who originally received approval of the temporary use seeks approval for a new temporary use permit for the site.
Staff recommends retaining the original Board-approved conditions (Conditions 1-4) from Resolution 2024-013 and adding a new condition stating that the temporary use permit will be valid for one year, with the possibility of time extensions granted by the Board in accordance with the LDR.
